Shadeflair Terms and Conditions

Article 1 - Definitions

In these general terms and conditions the following terms are understood to mean:

  • Reflection period : The period within which the consumer can make use of his right of withdrawal.
  • Consumer : The natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.
  • Day : Calendar day.
  • Right of withdrawal : The option for the consumer to cancel the distance contract within the cooling-off period.
  • Entrepreneur : The legal entity that offers products and/or services remotely to consumers.
  • Distance contract : A contract for which use is made of distance communication techniques, such as a webshop.
  • Distance communication technology : Means that can be used to conclude an agreement, such as the internet or telephone.

Article 2 - Identity of the entrepreneur

Article 3 - Applicability

  1. These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
  2. Before the agreement is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed before the agreement is concluded where these terms and conditions can be consulted digitally.
  3. In the event of any conflict between specific product conditions and these general terms and conditions, the specific product conditions shall prevail.

Article 4 - The offer

  1. The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow the consumer to properly assess the product.
  2. Obvious mistakes or errors in the offer do not bind the entrepreneur.
  3. Each offer contains such information that it is clear to the consumer what rights and obligations are associated with accepting the offer.

Article 5 - The Agreement

  1. The agreement is concluded at the moment the consumer accepts the offer and meets the conditions set.
  2. If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of the acceptance.
  3. The entrepreneur takes appropriate measures to secure the electronic transfer of data and ensures a secure web environment.

Article 6 - Right of withdrawal

  1. The consumer has the right to cancel the agreement without giving any reason within 14 days after receiving the product.
  2. If the consumer exercises his right of withdrawal, he returns the product to the return address at his own expense.
  3. Returned products must be returned undamaged and, where reasonably possible, in their original packaging.

Article 7 - Costs in case of withdrawal

  1. The direct costs for returning the products are borne by the consumer, unless otherwise agreed.
  2. If the consumer has paid an amount, this amount will be refunded as soon as possible, but no later than 14 days after cancellation.

Article 8 - Exclusion of the right of withdrawal

The right of withdrawal does not apply to:

  1. Products manufactured to consumer specifications.
  2. Hygiene products where the seal has been broken.
  3. Products that can spoil quickly or have a limited shelf life.

Article 9 - Conformity and warranty

  1. The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications stated in the offer and reasonable requirements of soundness.
  2. Any defects or incorrectly delivered products must be reported in writing within 14 days of delivery.

Article 10 - Delivery and execution

  1. The entrepreneur will exercise the utmost care when receiving and executing orders.
  2. Delivery will take place at the address specified by the consumer.
  3. Exceeding the delivery time does not entitle the consumer to compensation.

Article 11 - Payment

  1. Unless otherwise agreed, amounts owed by the consumer must be paid within 7 days after the start of the cooling-off period.
  2. The consumer has the duty to report any inaccuracies in payment details provided or stated to the entrepreneur without delay.

Article 12 - Complaints procedure

  1. Complaints about the performance of the agreement must be submitted fully and clearly described to the entrepreneur within a reasonable period via info@shadeflair.nl
  2. Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt.

Article 13 - Disputes

  1. Agreements between the entrepreneur and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law.
  2. Disputes are preferably resolved by mutual agreement.

Article 14 - Additional provisions

  1. The entrepreneur reserves the right to change these conditions unilaterally.
  2. Any changes will be communicated promptly and clearly via the website.
